1. Eligibility (16+ only)
hoop is for people 16 years and older. By using hoop, you confirm you are at least 16. If we believe you are under 16, we may suspend or delete your account.
2. Your account
You are responsible for activity on your account and for keeping it secure. Don’t share access credentials. You must provide accurate information and keep it up to date.
3. No objectionable content or abuse
You must not post, upload, share, or encourage content or conduct that is:
- Illegal, exploitative, or harmful.
- Sexual content involving minors (zero tolerance).
- Non-consensual sexual content, or sexual content shared without permission.
- Child abuse material, grooming, or exploitation of any kind.
- Violence, threats, incitement, or instructions for wrongdoing.
- Harassment, hate, or targeted abuse.
- Self-harm promotion or encouragement.
- Doxxing, privacy invasion, stalking, or unlawful surveillance.
- Impersonation, scams, fraud, or deceptive behaviour.
- Spam or manipulation (including fake engagement).
- Infringement of others’ rights (copyright, trademarks, privacy, confidentiality).
Use the in-app tools to report content/accounts and to block users. Do not misuse reporting.
4. Your content (you are responsible)
You are solely responsible for content you create, upload, or share (“User Content”) and for your conduct on hoop. You represent and warrant that: (a) you own or have all necessary rights/permissions to your User Content, (b) your User Content does not violate law or anyone’s rights, and (c) you have consent from any person appearing in your User Content.
5. Rights you grant us
You own your User Content. By posting it on hoop, you grant hoop a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable licence to use your User Content in any way we need to operate, secure, improve, and moderate hoop, and to promote and advertise hoop on and off the app, in any media now known or later developed.
You waive any right to payment, approval, or attribution for these uses to the maximum extent permitted by law. To the extent permitted by law, you consent to acts that might otherwise infringe your moral rights.
6. Moderation and enforcement
We may (but are not required to) review, filter, restrict, remove, or disable access to User Content or accounts, and we may do so at any time, for any reason, including to enforce these Terms, reduce harm, or comply with law. We may preserve evidence and cooperate with authorities where required or appropriate. For support or reports: support@myhoop.app.
7. Your responsibility to us
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless hoop and its team from and against any claims, demands, proceedings, investigations, losses, liabilities, damages, costs, and expenses (including legal fees) arising out of or related to: (a) your User Content, (b) your use of hoop, (c) your breach of these Terms, or (d) your violation of any law or rights of any person.
8. Purchases
If offered, purchases and subscriptions are billed by Apple. Cancellations and refunds are handled under Apple’s processes and applicable law.
9. Availability
hoop is provided “as is” and “as available”. We may change, suspend, or discontinue any part of hoop at any time.
10. Liability (limits that the law allows)
To the maximum extent permitted by law: (a) we are not responsible for User Content or user conduct, and (b) we exclude all liability for indirect, incidental, special, consequential, or punitive loss, or loss of profits, data, goodwill, or opportunity.
To the extent we are liable despite the above, our total aggregate liability is limited to the amount you paid (if any) to use hoop in the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes or limits any rights or remedies you may have under the Australian Consumer Law or other laws that cannot be excluded or limited.
11. Termination
You can delete your account in the app. We can suspend or end access if you breach these Terms or create risk or harm. Rights you grant to us continue for User Content already used, shared with others, retained in backups, or required for legal/security reasons.
12. Changes
We may update these Terms at any time by posting an updated version here (or in-app). Changes are effective when posted. By continuing to use hoop after changes take effect, you agree to the updated Terms. If you don’t agree, stop using hoop and delete your account.
13. Governing law
Queensland, Australia governs these Terms, except where mandatory local law says otherwise.
